<p>The United States Supreme Court, while passing the judgement over Troxel v Granville trial, made a landmark decision concerned with the visitation rights of grandparents. According to the decision taken by the Supreme Court in this case, it is the fundamental right of the parent to care for the children and have control of their children. At the same time, it stated that no law can set standards for visitation rights of grandparents. They must be applied on a case-by-case basis. The court declared the non-parent visitation statute of Washington as unconstitutional infringement of parents&#8217; rights to make decisions regarding their children.</p>
<p>Although the court did not provide any special benefits to the grandparents, it advised the parents to have a liberal attitude and work towards developing a bonding between the grandparents and their grandchildren. The court acknowledged the parental role was being taken over by grandparents in many families.</p>
<p>After the decision taken by the US Supreme Court in Troxel case, the grandparents&#8217; visitation rights are being determined based on the best interests of the grandchildren. All 50 states in the United States have statutes for grandparent visitation. Although many scholars feel that there would be least impact of the decision taken in the Troxel case, the state courts have a different opinion. According to them, as constitutional challenges for confrontation of the third-party visitation rights statutes increases, more number of statutes will be declared unconstitutional. There is no legal uniformity pertaining to grandparent visitation rights in the US considering all the exceptions that can arise. According to the statutes, in cases of troubled family situations, the courts must legally permit the grandparents to continue their loving relation with their grandchildren. <p>Sometimes a little bit of humor can help us put things in perspective and relieve a little bit of tension in a given situation. Mediation is a great tool to resolve divorce issues, but it doesn&#8217;t work in every situation, especially in a situation where the parties are set on a particular outcome.</p>
<p>With that in mind, I offer you a list of 10 signs why mediation may not work in your divorce. While some of these 10 signs may seem silly, they all contain a grain of truth which can make mediation a useless pursuit for the parties. They can reflect a particular state of mind that is not really conducive to negotiating and reaching a divorce settlement agreement.</p>
<p>I use the second-person singular pronoun, &#8220;you&#8221; for the purpose of clarity. But &#8220;you&#8221; can be your spouse, not necessarily you. These are not in any particular order, although the first one is very real.</p>
<p>1.        You want to win-no matter what the cost may be. This can be a financial as well as an emotional cost.<br />
<br />2.         You and your spouse can&#8217;t agree on what day it is, much less sit down to talk civilly with each other.<br />
<br />3.         When you ask each other a question, the answer is &#8220;talk to my lawyer.&#8221;<br />
<br />4.         You think mediation is for pansies and weak-willed people. Examples of famous people who easily dispel this fantasy, and who engaged in mediation or negotiation, include Madonna (in her recent divorce), and baseball player Alex Rodriguez.<br />
<br />5.         You think negotiating is a sign of weakness.<br />
<br />6.         You think there is only one solution to a problem.<br />
<br />7.         You think &#8220;My Way&#8221; is a lifestyle and not just one of Frank Sinatra&#8217;s signature songs.<br />
<br />8.         You think &#8220;The War of the Roses&#8221; is a fictional movie. It is a fictional account until you remember a particularly horrific news item in your local newspaper.<br />
<br />9.         You&#8217;d much rather subsidize your lawyer&#8217;s country club fees than split any assets with your spouse.<br />
<br />10.       You&#8217;re stuck in the past. Your focal point is not the present or future, with a view to finding solutions.</p>

<p>When a couple decides to dissolve their marriage and go through the process of divorce, several decisions need to be made regarding division of assets and child support/custody. However, one subject might cause more controversy than what one might initially imagine: pet custody. It is understood that pet owners truly love their animals and often treat them as children. For couples who share a pet, they may have to make some decisions about who the pet should live with, if the other spouse will receive visiting rights or if the other spouse will have to pay for the pet&#8217;s care.</p>
<p>In the state of Texas, pets are seen as a form of property. Because of this, the rights are limited as to what legal determinations can be made regarding the pet&#8217;s fate. Even if the pet is viewed as &#8220;like a child&#8221; to the couple, the court cannot reflect this relationship. Unfortunately, no accommodations can be made (legally) to determine custody or support. Because of this, couples must view the dog as a monetary asset and either assign custody to one spouse or determine the pet&#8217;s worth, sell him or her, and divide the assets equally.</p>
<p>If the couple would like to create a visitation or joint custody plan for each other, that is acceptable but it cannot be legally enforced.</p>
<p>Because these laws are not very helpful to pet owners who are seeking these kinds of structures, there may be a growing need for them in the future. We may be seeing more and more laws popping up that gives pets and their owners more rights during a divorce.</p>

<p>When a couple decides to get a divorce, one of the parents will be appointed custody of the children that they have. Because each parent needs to share the expenses of the offspring that they have, the court will set an amount that the non-custodial parent will be assigned to pay the custodial parent every month. This money will go towards expenses for the kids such as food, clothing, and school supplies. Depending on how many kids you have and how much the non-custodial parent makes will determine how much your child support will be.</p>
<p>The Texas Family Code is set up with a specific schedule to help determine the child support for parents with kids. This schedule assumes that the non-custodial parent will have an income of $90,000 a year which equals out to about $7,500 a month or less. For a parent with one child, the child support will be about 20% of the non-custodial parent&#8217;s income. For a parent with two children, the child support will be about 25% of the non-custodial parent&#8217;s income. For a parent with three children, the child support will be about 30% of the non-custodial parent&#8217;s income. For a parent with four children, the child support will be about 35% of the non-custodial parent&#8217;s income. For a parent with five children, the child support will be about 40% of the non-custodial parent&#8217;s income. For a parent with six or more children, the child support will be about 41% or greater of the non-custodial parent&#8217;s income depending on what the judge decides at the family hearing.</p>
<p>All of these are basic numbers and are a guide to figuring out what might be possible. The court will also take ample time to look at the incomes of both parents and the home arrangements of each parents and decide who will receive custody of the children. Along with having to pay child support, the parents are also required to have insurance on the child at all times. So whether it is from one parent or the other, they both are required to have some kind of insurance on the child in case of any accidents. Remember that even if you and your former spouse make an agreement between each other for child support, it is not legally binding in the court. The court will completely dismiss what you have discussed and make a ruling of its own.</p>
