Before officially filing for a divorce petition in your local court, it’s essential to know about the case options that you can consider. This article discusses the basics of a contested divorce and gives you an overview of what you can expect. Read the helpful information well so you can decide whether this type of case is suitable for your current circumstances.

How Does a Contested Divorce Work?

When a divorcing couple cannot resolve their settlement agreement civilly, one of the spouses can file for a petition in their local court. The other spouse will then be served with divorce papers and is given a certain period of time to respond. If he or she strongly disagrees with the demands stated on the document and still no resolution has been made, both parties will now be required to show up in court and defend themselves. This type of divorce case is can be very lengthy, stressful and expensive, and usually involves the assistance of lawyers.

Advantages

- The court will monitor the entire proceedings and make decisions that are just and suitable for both parties so you can be sure that you’re getting what you truly deserve from the settlement.

- If you and your soon-to-be ex spouse have substantial assets, joint bank accounts, minor children and other major divorce issues, having a contested case really helps because the properties and custody arrangement will often be fairly divided and decided by the judge.

- If you have specific settlement demands or perhaps seek the sole custody arrangement of your child, bringing the matters to court will give you a better chance of winning the case.

Disadvantages

- Since a contested divorce requires court intervention, it is often more expensive than the other type. In a complicated proceeding like this, you’ll need an experienced divorce attorney to represent you properly which also adds up to your costs.

- Contested divorce cases take much longer to settle because of all the investigation, hearings, counter-petitions, custody battles, mediations and other processes involved. They usually last for one or more years, and it can also give physical and emotional stress to both parties.

- This type of divorce is also more complex since many issues will be tackled. It can be very complicated and confusing at times, so it’s important to always be under the guidance of your attorney. This way, you can choose wise decisions and make the case more favorable to you.

When Should You Consider Filing for this Type of Case?

Contested divorce should only be chosen if you and your spouse truly cannot settle anything on your own. Nothing will happen if you keep on waiting for your husband or wife to come around, so you have no choice but to take it to court. This type of divorce is also advisable for disputing couples with too many properties to divide and minor children to fight custody over. The court’s intervention will often ensure a better proceeding and keep your rights protected.

But before consider this option, be sure to try resolving the settlement peacefully with your spouse first. If he or she refuses to cooperate, then it’s time that you let the court oversee the development of your divorce case.

It is an unusual situation you may find yourself in when attempting to show yourself as the best possible parent while proving the other parent is unfit. While many people believe the other parent is unfit the line is certainly not clear. What is unfit? If you poll 100 different Judges you will get 100 different definitions. Your desire to prove your former spouse unfit may lead you to take a more extreme position on the issues than you might normally take. You will not look good to the court by doing this.

There is no winner in a custody battle. The children involved certainly gain nothing regardless where they reside. At best you can only work to minimize the damage divorce brings to your children. Remember, your children are not possessions, they are people who have emotions and feelings. They love their parents, in most cases, both of them so you do a great deal of harm by attempting to damage your former spouse in your custody fight. Stay on high ground, you can win by being better prepared.

The first thing you should do in the beginning stages is get temporary custody. The old adage of possession being 9/10th of the law may come into play when the time comes for a decision to be made regarding where your children will reside. This move assumes you have hired a competent attorney who understands family law in your state. Don’t take the advice of your friend or anyone else who may advise you on how to proceed. Find the best lawyer in your community. Trust me, it will be money well spent.

Second on the list of importance is documentation. You must document everything no matter how insignificant you think it may be. No one every lost a custody battle by having too much documentation. Your emotions will be all over the place during this process and documenting things can help you sort out what is important and what is not. It also shows the court of your willingness to make an effort to keep custody of your children. You would be surprised how many parents don’t bother to do a simple thing like document everything in their quest for custody. Don’t inject opinions or sling mud in your documentation, just keep it factual.

These few tips can really make a difference in gaining custody of your children. For more Child Custody Strategies visit my website Getting Child Custody.

When you are looking to file for divorce, you begin to understand how complicated the Texas Divorce Laws really are. There are a few steps that you must take in order to file for divorce accurately. The first portion is the residency and filing requirements. In the state of Texas, there are certain residency requirements that must be met in order for the court to allow the case. When the court discovers it doesn’t have rights to hear the case, it will dismiss the case and not allow it. These are the requirements:

Someone who is not previously a resident of the state and is serving in the armed forces of the US must have been stationed at one or more military bases in the state for at least the last six months. Also the person must have been in the specific county that they are filing in for at least 90 days to be considered a Texas domiciliary and a resident of the county for the purpose of filing suit.

A divorce may not be accepted in Texas unless at the time the suit is filed either the petitioner or the respondent has been all of the following; first, a domiciliary of Texas for the past 6 months, second, must be a resident of the county where the suit is being filed for the past 90 days. If the resident spouse has been residing in the state of Texas for the last six months and the non-resident spouse lives in a different state, the non-resident spouse is still allowed to file a suit for divorce in the county that the resident is living in.

When filing for divorce, you have to have a valid reason for filing the petition. There are 7 different reasons for filing for divorce; No Fault, Cruelty, Adultery, Conviction of Felony, Abandonment, Living Apart, and Confinement in Mental Hospital. No Fault means that the court says that the court says that there is a discord between the two spouses and end the divorce in no fault for anyone. Cruelty means that the court will favor one spouse because the other is guilty of cruel treatment toward the complaining spouse. The treatment must be of such a hostile nature that living together any more is intolerable. Adultery means that one spouse has committed adultery and the court will favor the other spouse. Conviction of Felony means that one of the spouses has been convicted of a felony and has been in jail or prison for at least one year and has not been pardoned. Remember that if you testified for your spouse or even against your spouse, the court will not give you this type of divorce. Abandonment means that one spouse left the other with intent to abandon and has been away from the other for one year or more. Living apart means that the spouses have been living separately for three years or more. Confinement in Mental Hospital means that the court will grant you a divorce because one spouse has been legally confined in a state mental hospital for at least three years or more. After the divorce is final, you will need to go through a name change for the females.

Each state in the U.S. has its own residency laws for individuals seeking divorce. In order to legally seek divorce within a state, you must meet the residency requirements. Contrary to popular belief, you do not have to file for divorce in the state in which you were married. Most people file for divorce within the state and county in which they currently reside.

If you have recently moved from one state to another and are considering divorce, you may find yourself in a unique situation. Before pursuing divorce be sure that you know what the residency requirements are for your new state. This information will help determine how you proceed with your divorce.

Texas Residency Requirements

To qualify for divorce in the state of Texas, one spouse must have lived in Texas for the past six months. It is not necessary for both spouses to have residency status in order to file for divorce. In addition to the state residency requirement, at least one spouse must have resided in the county in which the divorce is filed for a minimum of 90 days. If you do not meet these requirements your divorce case will not be accepted by the court.

If You Do Not Qualify

If you have recently moved to Texas, you and your spouse may not yet meet the state’s residency qualifications for divorce. If this is the case, there are still a few divorce options for you to consider:

Look up the residency requirements for the state in which you and your spouse previously lived. Since each state has different laws, you may be able to seek divorce in a different state.

If you do not meet the residency requirements but your spouse does, consider asking your spouse to file for divorce.

Consider waiting until you have been a Texas resident for 6 months, then file for divorce. You can use the waiting period to begin preparing for the divorce proceeding.

If you do not qualify for divorce in Texas, you may want to contact a Texas divorce lawyer to fully clarify all of the options that are available to you. He or she can answer any questions you may have about filing a divorce in Texas and can advise you on what may be the most favorable divorce option, depending on your situation.

Struggling through debt can put an incredible amount of strain on a marriage, and many couples facing serious debts find themselves contemplating a divorce. Filing for a divorce and filing for bankruptcy can be two of the biggest life decisions you’ll ever have to make, and it’s important to enter into the decision carefully and with both eyes open to the reality of the situation.

What Comes First?

When you’re considering filing for both divorce and bankruptcy, it can be difficult to know which to file for first. You may have a lot of questions that need answering. In general, going into a divorce while carrying a lot of debt makes the divorce process even more difficult than it already is. Filing for bankruptcy before filing for divorce will put an automatic stay on your debts, meaning that your creditors will not be able to try to collect on the money you owe them. This automatic stay is a good first defense to protecting your property going into a divorce.

Additionally, filing for bankruptcy before your divorce can protect you from the possibility of creditors trying to collect on money following a divorce. Just as your property is divided during a divorce, so are your debts. However, though you and your spouse may come to an agreement about who will take on how much of the communal debt, your creditors may try to reclaim the debt from either spouse. By clearing out the debt before the divorce goes through, you can ensure that you won’t be saddled trying to pay off someone else’s debts.

Some Tips

When you’re going through both a divorce and a bankruptcy filing, you probably have a lot of questions you’re asking yourself. These tips might help you with the process:

· Discuss your financial prospects with your spouse before initiating any marital decision. Once you’ve discussed it together, it can help to talk to a bankruptcy lawyer about your financial situation.

· Make sure to get a property lien if you’re worried about your spouse’s bad credit affecting your property after the divorce. A property lien can protect you from debt collectors coming after your former spouse’s assets.

If you’re going through a divorce and you have questions about your financial prospects, an experienced bankruptcy lawyer can help.

Divorce records are considered public records in all states although there may be variations in the way they are governed and treated from one state to another. To search divorce records in any of the states, there are basically two options: government or private. Government sources are generally thought to be free, albeit largely the contrary in Texas while higher expectations are placed upon private ones. Either will work and is a matter of individual preference or situation.

The government department which is in charge of divorce records in Texas is the Texas Department of State Health Services and the service is provided out of its Vital Statistics Unit under the Report of Divorce Index section. These indexes can be downloaded free of charge from the department’s website. There are close to a hundred thousand divorce files maintained by the office but its function to this end is limited to primarily providing verification letters associated with divorce.

A Divorce Letter of Verification from the Vital Statistics Office only states whether or not a divorce was issued in the state of Texas. It contains the names of the divorcing parties, the county where the divorce was granted and the court case number. Fees are $20.00 for a letter. They are considered searching charges and hence not refundable or transferable to another record whether or not a search yields any results. However if a search results in a ‘no record found’, it can be used as proof of single-status (marital). Verification letters are available to divorces that occurred from 1968 to the last day of the year preceding the current one.

For other divorce records such as certified copies of Divorce Certificates and Divorce Decrees, you must contact the District Clerk’s office in the county where the divorce was filed as they are not maintained at the Vital Statistics Office. On that same note, Reports of Divorce Indexes before 1968 are not available there either due to the fact that divorce applications were not filed with the State offices until 1968 so they too have to be obtained at their office of origin in the respective counties.

Texans are a special lot. The reasons behind their search for Texas Divorce Records are varied and flowery. There are also Texans who have resided in multiple states or county prior to Texas. As such, the complete divorce records of these folks will cut across state borders and the various state public record databases are not linked. As a result, employing government agencies for multiple-state divorce record searches becomes unfeasible. That’s why private record providers are the preferred option for Texas Divorce Records Search especially when time and personal bandwidth are a constraint. Their databases typically cover all states.

Commercial record providers are the end-all solution for those who can see past the fees involved but only if you signed up with the right one. The demand for this type of service has soared in recent times due to its obvious edge over using public agencies. This has consequently attracted many pretenders onto the bandwagon. Having that said, it’s not difficult to identify the bona-fide providers. One of the best ways is to check out the review or specialist sites which are abundantly found in any of the major search engines. They seldom miss.
