Have you ever happened across the Jerry Springer Show (I know this group can’t actually be Tivoing it or anything…too high class a crowd) and noticed how people who are cheaters can’t seem to venture too far from home? I mean, the “other partner” always seems to be drawn from a very shallow pool of best friends, sisters, brothers, father-in-laws, etc. All the time.

If you are going to cheat, at least get far enough from the nest that you at might have a fighter’s chance at not getting caught. Right? And good grief, does anyone ever think about how awkward the family time at Thanksgiving is going to be when all of the dust clears?

For the record, no. Cheaters don’t think about any of this stuff. There is no thought process there. Just the occasional adrenaline rush.

Whatever.

Practically speaking, cheaters are by definition non-thinkers. Consideration of details like process and consequences generally cannot be bothered with at all, let alone managed effectively in these situations. So then, it’s not surprising that cheaters tend to get found out…and lose.

Now, don’t get me wrong. I’m not discounting the concept of someone wanting out of a dismal relationship so badly that they may actually want to get caught cheating, just so the burden of ending the relationship is on the other person. I’m sure that enters into it often, actually.

Heavy stuff. Or should I say, pathetic stuff.

Obviously I ruminate upon this sort of thing a good bit. I should, after all it’s my job to. But still, the concept of cheating on a partner in a committed relationship always causes me to rehearse the line, “what goes around comes around” just one more time.

Why?

Well, it’s simple. We as human beings have a pattern. Whether we like it or not, we tend to be painfully predictable. At the very fiber of our being, what makes up our moral core is going to dominate…every time.

So it follows logically that if you choose to cheat, you are going to live the life of a cheater.

Somebody reading this just said, “Duh.”

I couldn’t agree more. “Duh.” So what is up with all the cheating? There are clear consequences to living that lifestyle, and they basically involve getting what you deserve…infidelity. Essentially, if you build a relationship upon the premise of cheating, how can you possibly expect anything in the future but…more cheating? It has been said that after the first time cheating happens, it is forever easier thereafter to repeat the offense. I think there is decidedly some truth to that concept. Once conscience is breached, the proverbial Pandora’s Box is opened.

Suppose for a brief second that you are feeling bored, sick, unattracted and/or flaky toward you committed partner. You have an affair with someone who “floats your boat” more buoyantly. Yeah, well, both you and your new, apparently exciting friend are CHEATERS. And should you choose to leave your committed partner for your new friend, you will both still be CHEATERS.

The takeaway here is that both YOU and your PARTNER will have built whatever you build together upon CHEATING.

Did you get that? And guess what? You’ll do it again.

Like it or not, cheaters indeed keep cheating. Yours will be a relationship built upon dishonesty and lack of integrity. How do you expect such a union to last? Rest assured it will not.

Meanwhile, your spurned ex will be out deserving what he or she wants. A faithful partner is a good catch.

Will you be left wallowing in the error of your ways? Not if you deserve what you want today…and stay true to the partner you say you love. If there are issues, work them out. If you need to get out more together, make it happen. And if you need to break up an exclusive relationship, do so before heading on to “greener pastures”. The proper thing to do is break off one committed relationship before starting another. This is the only way around the cheating issue. And yes…if you are “separated”…consider thoroughly the importance of waiting until the divorce is final before dating other people. You are still married until that happens, and dating under these circumstances generally raises subtle doubts in the mind of those you go out with.

But for Heaven’s sake…whatever you do, don’t sleep with your brother-in-law just to make a point, okay? It’s not going to lead to happiness.

Before officially filing for a divorce petition in your local court, it’s essential to know about the case options that you can consider. This article discusses the basics of a contested divorce and gives you an overview of what you can expect. Read the helpful information well so you can decide whether this type of case is suitable for your current circumstances.

How Does a Contested Divorce Work?

When a divorcing couple cannot resolve their settlement agreement civilly, one of the spouses can file for a petition in their local court. The other spouse will then be served with divorce papers and is given a certain period of time to respond. If he or she strongly disagrees with the demands stated on the document and still no resolution has been made, both parties will now be required to show up in court and defend themselves. This type of divorce case is can be very lengthy, stressful and expensive, and usually involves the assistance of lawyers.

Advantages

- The court will monitor the entire proceedings and make decisions that are just and suitable for both parties so you can be sure that you’re getting what you truly deserve from the settlement.

- If you and your soon-to-be ex spouse have substantial assets, joint bank accounts, minor children and other major divorce issues, having a contested case really helps because the properties and custody arrangement will often be fairly divided and decided by the judge.

- If you have specific settlement demands or perhaps seek the sole custody arrangement of your child, bringing the matters to court will give you a better chance of winning the case.

Disadvantages

- Since a contested divorce requires court intervention, it is often more expensive than the other type. In a complicated proceeding like this, you’ll need an experienced divorce attorney to represent you properly which also adds up to your costs.

- Contested divorce cases take much longer to settle because of all the investigation, hearings, counter-petitions, custody battles, mediations and other processes involved. They usually last for one or more years, and it can also give physical and emotional stress to both parties.

- This type of divorce is also more complex since many issues will be tackled. It can be very complicated and confusing at times, so it’s important to always be under the guidance of your attorney. This way, you can choose wise decisions and make the case more favorable to you.

When Should You Consider Filing for this Type of Case?

Contested divorce should only be chosen if you and your spouse truly cannot settle anything on your own. Nothing will happen if you keep on waiting for your husband or wife to come around, so you have no choice but to take it to court. This type of divorce is also advisable for disputing couples with too many properties to divide and minor children to fight custody over. The court’s intervention will often ensure a better proceeding and keep your rights protected.

But before consider this option, be sure to try resolving the settlement peacefully with your spouse first. If he or she refuses to cooperate, then it’s time that you let the court oversee the development of your divorce case.

Marriage is the oldest institution on the planet. The Bible, in Genesis, tells of how God created Adam and Eve, and married them. However, almost as quickly, the rise of divorce came about. By the time of Moses, the practice was commonplace, and in the book of Numbers he lays down the laws for dealing with the annulment of a marriage.

It is to be the exception, rather than the rule. In Asian cultures, we are given to understand, it was a bit more commonplace. Nowadays, it is even more so. The history of this subject through out the ages is a fascinating one. Let us turn to it now.

Besides the Biblical account and some fragmentary evidence from other cultures, there is not much on the practice in the western world until the rise of the Greek and Roman civilizations around 1000 BC. In the eastern world, due to the low status given the institution of marriage, with many husbands taking several lives, it was regarded to be quite common. In Muslim countries, divorce is lawful, but is the most hated of all lawful things in the sight of Allah.

By the time of Greek society, however, marriage was regulated and accepted. In ancient Athens, all you had to do was to submit a request to a magistrate, who would judge whether the request was lawful and would then either accept or deny the request. In early Roman culture, it was disapproved of, but later, as Rome became more decadent, it adopted the maxim that, marriages ought to be free. Theoretically, either the husband or the wife could divorce at will, although in practice the exercise of this right was infrequent.

When the Christian religion became dominant, marriage became more permanent. Very few people sought to end their marriages during the middle ages, although some, such as the notorious Henry VIII, defied the morality of the day. During the course of his reign, he took a total of six women as his wife, beheading two of them.

In Victorian times, it was still prejudiced against, but, again, still practiced on occasion. It was more frequent for an informal divorce to occur where, though still technically married, the husband and wife would be separated. This was quite commonplace throughout the 18th and 19th centuries, although towards the end of the 19th century attitudes began to swing back the other way.

Today, the separation of a husband and wife is common, and the legal process of ending a marriage is even more so. In the United States, 40% of marriages do not last until the death of one of the parties. This is a far cry from the standards of earlier times.

It is an unusual situation you may find yourself in when attempting to show yourself as the best possible parent while proving the other parent is unfit. While many people believe the other parent is unfit the line is certainly not clear. What is unfit? If you poll 100 different Judges you will get 100 different definitions. Your desire to prove your former spouse unfit may lead you to take a more extreme position on the issues than you might normally take. You will not look good to the court by doing this.

There is no winner in a custody battle. The children involved certainly gain nothing regardless where they reside. At best you can only work to minimize the damage divorce brings to your children. Remember, your children are not possessions, they are people who have emotions and feelings. They love their parents, in most cases, both of them so you do a great deal of harm by attempting to damage your former spouse in your custody fight. Stay on high ground, you can win by being better prepared.

The first thing you should do in the beginning stages is get temporary custody. The old adage of possession being 9/10th of the law may come into play when the time comes for a decision to be made regarding where your children will reside. This move assumes you have hired a competent attorney who understands family law in your state. Don’t take the advice of your friend or anyone else who may advise you on how to proceed. Find the best lawyer in your community. Trust me, it will be money well spent.

Second on the list of importance is documentation. You must document everything no matter how insignificant you think it may be. No one every lost a custody battle by having too much documentation. Your emotions will be all over the place during this process and documenting things can help you sort out what is important and what is not. It also shows the court of your willingness to make an effort to keep custody of your children. You would be surprised how many parents don’t bother to do a simple thing like document everything in their quest for custody. Don’t inject opinions or sling mud in your documentation, just keep it factual.

These few tips can really make a difference in gaining custody of your children. For more Child Custody Strategies visit my website Getting Child Custody.

Lawyers and expense go hand in hand. There is no doubt about it, lawyers are expensive. More importantly divorce lawyers can be even more expensive. There can be nothing worse than paying a lawyer to help legally discontinue marriage, which has been a foundation of your life for a long time. You are actually making a change to your life, which you don’t like, and you are actually paying somebody to do it for you! There are quite a few people who think along these lines. Such people will feel that they have been handed a golden cup, if we tell them that, yes its possible to get a divorce without a lawyer.

The Pro Se Divorce

Another word for this would be the ‘Do It Yourself Divorce”. Of course, both the partners must be in agreement with this way of doing things and more importantly there are only certain conditions wherein the Pro Se divorce is applicable. All in all this type of divorce, which precludes the need for any attorney requires that both the parties fill up the divorce papers themselves and not hire a lawyer to do so. It must also be said the fact that you are not hiring a divorce lawyer might not be a good option for anybody and everybody.

The Criteria to Be Fulfilled

To file for a Pro Se divorce, the divorce must not be contested by both the parties with respect to assets, property, or children. With regards to the children, they must be of a legal age and thus should also have no involvement in the divorce case. In marriages there are always various investments made during the course of the marriage, or debts incurred over a period of time. However, when it comes to a Pro Se divorce there must no investment such as pension options, retirement options, stocks or deposits associated with any of the partners.

This is because alimony is not included in the process of a Pro Se Divorce. If you want to deal with alimony issues then its best that you get a lawyer for the same.

A Few Rules

It is necessary that both parties must agree to a Pro Se divorce and you can’t have the husband opting for such a divorce, while the wife hires a lawyer for the proceedings. If one or both of the spouses are in the military then they cannot file for divorce under this option.

If there has been a history of mental and physical abuse by one partner on the other, or by both the partners on one another, then such divorce cases do not come under the purview of a Pro Se divorce. Another pre condition for a Pro Se divorce is that both partners must be well off after the divorce proceedings are over and not look for financial support from one another.

The Advantage of ‘No Lawyer’ Divorce

As aforementioned, hiring a divorce lawyer is an expensive business. Therefore a divorce without a lawyer saves both parties a lot of money when it comes to lawyer’s fees. However, it would be a good idea if you know all the legalities of this type of divorce before you initiate the proceedings. You should have a clear idea about all the documentation work and the kind of information that will be needed.

It is a sad fact that of all Americans who have been married, one out of three has also experienced at least one divorce. With the vast majority of people in America being married one or more times, it is common knowledge that every couple goes through a few rocky patches. Many marital problems can be solved with open communication and a solid commitment to one another. For more serious issues, some couples turn to marital counseling and may find renewed strength at the end of that journey.

Unfortunately, some problems escalate into insurmountable barriers to a successful marriage. Generally these seemingly unsolvable issues stem from one or both partners refusing to address their problems while they are still manageable. Someone’s feelings get hurt, resentment festers, and eventually one spouse detaches emotionally from the other. The further into this cycle a couple is, the more likely they will find themselves in divorce court.

The downhill slide that ends in separation usually begins with communication problems. It may start with keeping secrets, and soon one or both spouses avoid talking to each other about marital problems or possibly even life in general. A failure to communicate with each other indicates a lack of trust, which is the foundation of marriage.

Shortly following a breakdown in communication, a partner may begin to employ personal defense mechanisms that will continue to weaken the marital bond. Stonewalling tactics, being overly defensive, or dismissing the other spouse’s feelings makes healthy conflict resolution impossible. Avoiding conflict or engaging in negative defense mechanisms serves only to poison a marriage.

On the other hand, a spouse may make multiple efforts to address marital problems only to be shut out by the other who is utilizing unhealthy defenses. Eventually the spouse making an effort to correct issues in the marriage will tire of being ignored and may even begin to distance his or herself from the other partner. At this point, it is highly likely that one or both spouses may give up entirely and lose any interest in saving the marriage.

Is there a “point of no return” when a marriage is doomed? Certainly there is. However, that point is different for each couple. The key to saving a marriage is willingness to save it. If one or both spouses have given up on their partnership, there is not much hope. For couples who have not given up, the road to marital recovery requires honesty, communication, patience, forgiveness and commitment. It is a long and bumpy road, but then so is the road to divorce.

There is yet another category of foreclosure that reigns commonly in Austin, TX. Houses going into foreclosure or auctioned for sale are due to Divorce settlements.

Partners dissolving their marital relationship may find it quite difficult to straighten out their financial disputes. The spouse who has the slightest clue of separation or is not willing to divorce is least prepared for the results and effects of the divorce. While the partner who initiates the proceedings has the privilege of planning settlement terms ahead of time, the other spouse who is either demoralized, monetarily broken or is of a lower earning caliber, finds it quite hard to settle financial disputes over divorce.

If you are reading this, chances are that you might be navigating against a similar storm of complications. For the benefit of my Austin homeowners, I’ve always emphasized on the value of monitoring your score. A damaged or poor credit score can be a serious result of foreclosure. Also poor credit rating can also reduce your possibilities of obtaining other rescue loans. If you are going through a divorce settlement and wanting to stop a foreclosure, your foremost duty now is to know your credit rating. Review and analyze your credit report online.

If your divorce settlement involves your children, the court will create child support orders that lay conditions on payment, custody and protection, which falls in the best interest of the child. The court orders will control the complete rules of your kid’s health insurance, child support payments and visiting schedules. Usually the order equally delegates child support payment and guardianship rights between the divorce partners. Sometimes the parent who has the complete custody of the child can’t afford to make the mortgage payments. The court will often times order the non-primary spouse to contribute more to keep the children in the family home. Delinquent spouses usually will have to make up back house payments.

Petitioners in the Austin, TX Travis County region may find their divorce petition disputes being settled over a period of up to one year. Given the longevity of the case, the Judge may issue an emergency order that compels either one or both partners to fulfill their obligations towards mortgage payments. In addition the judge may order the defaulted house payments be paid by the spouse who initiated divorce.

If a divorce has handicapped your financial credibility and you want to stop your foreclosure, you can proceed to legally petition monetary support from your spouse.

* Negotiate with your spouse on making the mortgage current. If he or she is unwilling to abide, softly notify him/her about your plans to hire an attorney who could legally arbitrate the situation.

* Hire a lawyer and educate him/her on every detail about the current status and equity rights over the mortgage. Provide all documents, contracts copies and mail communications that can support your petition and advocate your rights over securing the mortgage.

* If your income does not allow you to hire an attorney, take leverage of your state law that could have provision for your delinquent spouse to cover up all legal charges, including your attorney’s fees.

* If the court sets an order for your divorcing spouse to pay off the mortgage loan, request the judge to permit you to contribute payments for those months your spouse has defaulted. It is better to request temporarily restriction against the lender from initiating foreclosure, than to lose the house on auction sale.

If in case your ex-spouse fails to make the mortgage current, the lender should be aware of the alternatives recommended by the court. Bear in mind, to constantly update your lender about all legal proceedings being negotiated with your ex-spouse on mortgage settlements. Send photocopies of all court orders to the lender for documentation against your mortgaged house.

You are having a little bit of trouble figuring out how you obtain a marriage license in Maine. Well there are a few roads you must cross. Do not worry though that is why I am here. Below I have outlined the latest laws and regulations for applying and obtaining a marriage license in the state of Maine.

You must have a government issued picture identification, certified birth certificate. You should also have your social security card and know your parents maiden names.

The couple must appear together when applying for a marriage license.

If the couple both reside in the state of Maine, in the same municipality they need to apply with their municipal clerk. If both persons reside in the State of Maine, in separate municipalities, they must file with at least ONE municipal clerk, they do not need to file with both.

Their are no waiting periods.

If you have been married before you must supply proof that the marriage ended. You must have either a divorce decree or death certificate.

The fees are $20.00. This charge does not include the cost of a certified copy of the marriage certificate after the marriage is solemnized.

Their are blood test requirements.

If you are 16-17 you must have written consent that is notarized. If you are under the age of 16 you must have written consent from parents and consent from a judge.

Cousins may marry, however you must take a genetic counseling course and receive a certificate.

As of July 1, 1981 the Secretary of State’s Office no longer requires a license be issued for ministers of the gospel for the purpose of solemnizing marriages in Maine.

The following persons can perform marriage in the state of Maine judge, a lawyer admitted to the Maine bar, A notary public under Title 4, chapter 19, An ordained minister of the gospel, A clerick engaged in the service of the religious body to which the cleric belongs and A person licensed to preach by an association of ministers, religious seminary or ecclesiastical body.

The license is valid for 90 days and only in the state of Maine.

These are the latest laws and regulations for applying and obtaining a marriage license in the state of Maine. I suggest that you call your local clerk to confirm the information above.
